On September 8, 2026, the US Government released three proclamations that will significantly impact its trade with Canada. Included in these proclamations are import exclusions/bans and tariff modifications on a wide range of Canadian products.
Import Exclusions/Bans
Effective September 29, 2026, the new exclusions/bans cover three categories:
Each proclamation includes an annex with a full list of the excluded or banned goods. Goods listed in the annexes of these proclamations are banned from importation into the US.
Tariff Modifications
Effective September 15, 2026, the US Government has also augmented existing tariffs on Canadian goods, including:
Importers are also encouraged to work closely with their brokers and double-check the existing Section 338 tariffs for changes. Each proclamation comes with annexes detailing the affected goods and should be reviewed carefully, as certain products like rock salt and cement have been removed but replaced with new products like ATVs and dairy products.
Notably, these Section 338 tariffs apply to all affected Canadian goods regardless of whether a good qualifies for the U.S.-Mexico-Canada Agreement (USMCA) and apply in addition to the tariffs imposed under Section 232.
