US to Implement Countervailing Duties on Canadian Mushrooms

The US Department of Commerce has announced a preliminary countervailing duty determination regarding fresh mushrooms from Canada.

US Customs and Border Protection (CBP) has decided, after an investigation that ran from January 1, 2024, to December 31, 2024. This is expected to be officially published on May 18, 2026, and is effective for merchandise entered or withdrawn from the warehouse for consumption. 

The final determination will be issued on the same date as the final “Less Than Fair Value” determination, which is currently scheduled to be issued no later than September 28, 2026, unless postponed.   

The rate for Canadian mushroom producers has been determined to range from 1.62% - 4.97% depending on the producer.  

Affected commodities include fresh mushrooms of the genus Agaricus from Canada. This includes, but is not limited to, button mushrooms, chestnut mushrooms, cremini or crimini mushrooms, baby bellas, portabella or portobello mushrooms, table mushrooms, or white or brown. The scope covers whole mushrooms, as well as mushrooms that have been sliced, diced, or separated into stems and pieces prior to importation. 

These commodities are currently classifiable under the Harmonized Tariff Schedule of the United States (HTSUS) statistical reporting number 0709.51.0100.
